The Court of Appeal recently upheld the High Court decision that look-alike drinks manufacturer Intercontinental Brands ("ICB") was liable to members of the Diageo group ("Diageo") under the extended form of passing off [Diageo North America, Inc and another v Intercontinental Brands (ICB) Ltd and others [2010] EWCA Civ 920].
