Court of Appeal rules on lease guarantees

Last Wednesday, 27 July, the Court of Appeal gave its judgment in a sale and leaseback case involving the House of Fraser department store chain.  The judges took the opportunity to tidy up some uncertainty regarding various forms of commercial lease guarantee. 

The court decided that some types of guarantee are valid, but some are not.  The differences between these types of guarantee are tiny, but the outcome will be significant for many landlords, tenants and their parent companies.
