Overview

Our strong track record of advising both investors and fund managers in relation to distressed asset funds gives us a deep understanding of the market and the capability to provide clients with pro-active and commercially-focused legal advice.

We have advised on a considerable range of special situations funds, in terms of fund structure, jurisdiction (of both funds and target companies) and investment method (including equity and debt).

Our clients include established fund managers, growing fund managers, and start-up fund advisers. Our team is used to advising on fund structures that allow tax-efficient investment in multiple jurisdictions, cater for a range of investors, and allow for tax efficient remuneration of executives located in multiple jurisdictions. We also have considerable experience in advising clients who are raising a first fund or who require a "trusted adviser" to engage with all stages of the process, from FCA authorisation, through marketing to first closing and investing in target companies.

In addition, we advise a wide variety of investors on their investment into distressed asset funds, including fund of funds investors and institutional investors. Our work for both investors and fund managers gives us a solid understanding of the distressed asset space and allows us to stay current with market developments.

We frequently draw upon the expertise of our restructuring and insolvency colleagues and their experience of advising on investing in companies in distressed situations, purchasing assets and businesses out of companies in distressed situations and restructuring companies near and in insolvency.
