Pensions benefit issues
We advise both employers and trustees on benefits issues,
including the interpretation of scheme rules, discrimination law,
Finance Act compliance, changes to benefit terms, termination of
accrual, and switching to career average or money purchase accrual
or alternative benefit designs. We advise employers on
employee consultations and negotiations with employees, trade
unions and trustees associated with changes in benefit
provision.
We also have experience of advising on the modification of benefits
for schemes transferring to the Pension Protection Fund and the
Financial Assistance Scheme.
We also advise on pension disputes relating to benefits and changes
to benefits, including assisting with internal dispute resolution,
Pensions Ombudsman proceedings and litigation in the courts.
We have been involved in three leading Court of Appeal cases
involving difficult points of pensions law.
We also advise on non-pension benefits such as share schemes and
other incentives.
