Same-sex partners win right to equal survivors' pension benefits

The Supreme Court issued its judgment in Walker v Innospec on 12 July 2017. The judgment reverses the earlier Court of Appeal decision in 2015 and confirms that same-sex partners are entitled to equal survivors’ pension benefits.

Schemes that have limited the survivors’ pension payable to same-sex partners by reference to pensionable service accrued on and after 5 December 2005 will need to take immediate action in relation to survivors’ benefits. This will include the need to revisit any same-sex survivors’ pensions paid on an unequal basis after 5 December 2005.
