The risk of AI misuse or malfunction brings with it the risk of claims brought by customers, contractual counter-parties and other third parties. AI will create new challenges for the courts and policy makers because existing rules have developed in a way that holds human actors and corporate entities (insofar as they have a separate legal identity) liable for their actions, or those of their agents.
