E-disclosure blues

The widespread use of emails and other electronic documents means that disclosure has become a bigger exercise than ever before.

The number of documents that need to be reviewed can extend into the millions. If not properly planned and executed, the disclosure process can cause significant problems for litigants and their solicitors.

This publication examines the case of West African Gas Pipeline Company Limited v Willbros Global Holdings Inc [2012] EWHC 396 (TCC), which is a recent example of a case where mistakes were made - and of the costly consequences of those mistakes.
