When is an enhanced redundancy package contractual?

Enhanced redundancy payments are sometimes made by employers who wish to be more generous to their employees than they are strictly required to be under the statutory regime.

Ensuring that this generosity does not solidify into a binding contractual right which the employees can enforce against the employer is important, with the "tipping point" not always easy to identify.
