Logos and No-gos: "design-a-store"

In a recent ruling by the CJEU, the design and layout of a retail store was found to be capable of being registered as a trade mark.

This judgment will be of great interest to retailers who place a lot of branding significance on the design and layout of their selling spaces.  However, retailers will still need to show that their store design and layout is distinctive and is capable of distinguishing their products and services from those of their competitors.
