Camilla Barry Partner

Camilla advises corporate groups, trustees and insurers on all aspects of UK pensions law and practice.

She advises both sponsors and trustees and other scheme providers on the administration of defined benefit and defined contribution pension schemes including: regulatory requirements, drafting and interpreting scheme documents, benefit changes and scheme closures, discrimination law, governance, liability management, administrative errors and corrections, complaints to the Pensions Ombudsman, scheme establishment, winding-up and transfers to the Pension Protection Fund.

Camilla has significant experience of advising in relation to the powers of the UK Pensions Regulator both in the context of corporate transactions and restructurings and in relation to funding negotiations, ”stressed” schemes and governance arrangements. Camilla has advised on several “regulated apportionment arrangements” requiring the agreement of the Pensions Regulator and the board of the Pension Protection Fund and on several proposed formal interventions by the Pensions Regulator.

Camilla regularly advises on the pensions aspects of corporate transactions, including the allocation of pension scheme liabilities, scheme transfers, management of s.75 debts, liabilities transferring under TUPE and exposure to trustee powers and the powers of the UK Pensions Regulator.

Camilla also advises insurers, asset managers and other pension providers on regulatory matters relating to private sector schemes, Local Government Pension Schemes, master trusts, SIPPs, auto-enrolment and pensions risk transfers (including insured pension buy-ins and buy-outs).
