LIDW26 session – Minds vs. machines: AI’s promise and limits in arbitration

The session adopts a hearing-style structure inspired by prior “Minds vs. machines” programs: counsel argue opposing positions before a tribunal, which issues a non-binding determination.
AI tools are increasingly used in arbitrator analytics, conflict checks, and predictive modelling. But should algorithmic systems influence or determine arbitrator selection?
This session frames the issue as a live dispute.
Proposition: AI-assisted selection enhances neutrality, diversity, and efficiency.
Opposition: algorithmic opacity threatens legitimacy, due process, and party autonomy.
Counsel will argue before a three-member tribunal. The tribunal will deliver a short reasoned “award” addressing:
- independence and impartiality;
- equality of arms;
- transparency and explainability;
- bias in training data; and
- challenge and enforcement implications.
The audience will vote before and after the award to measure persuasion shift.
