In this session, these issues are brought to life with real world case examples and share practical insights on:

  • how to approach protector powers and the risk of deadlock, drawing on experience analysing the position in the Privy Council (the highest appeal court for many common law jurisdictions);
  • responding when capacity is weaponised, based on our recent experience in numerous very delicate cases; and
  • when lawyers become the target: the claims that can be brought against lawyers involved in setting up structures, and how to avoid being the target of those claims yourself.
