Eloise is a senior associate (barrister) in the litigation group.
Eloise specialises in commercial, residential, mixed-use and rural real estate disputes, and related professional negligence matters. She has advised a wide range of clients including landlords, tenants, developers, housebuilders, private individuals, investors, and charities. Eloise has guided clients through litigation in the county court, High Court, and First-Tier Tribunal (Property Chamber), as well as having experience of mediation and expert determination. In addition, she works closely with the firm’s Real Estate and Private Client Property teams in order to advise clients at an early stage.
Eloise trained at the Bar, completing a pupillage at Falcon Chambers. She sits on the Law Reform Committee of the Property Litigation Association.
Experience
- Successfully obtained a number of property tribunal determinations for a resident-owned freehold company, in which residential statutory consultation requirements were dispensed with.
- Defending a leading financial services group and major global investor in county court proceedings relating to the forfeiture of a commercial lease.
- Successfully advised the nominee purchaser and participating tenants in S. Franses Limited and another v Block 6 Ashley Gardens Roof Gardens Limited and others [2023] EWHC 2880, Ch, enabling them to acquire roof garden leases which had been granted in 2012 without the strict requirements of the Landlord and Tenant Act 1987 having been complied with.
