Getting your breach of warranty claim off on the right foot
Ensuring strict compliance with any contractual notification provisions is important when seeking to bring a breach of warranty claim. However, adhering to such provisions is not always straightforward, especially if the provisions are ambiguous.
In the recent case of Nobahar-Cookson v The Hut Group Ltd  EWCA Civ 128, the Court of Appeal has given some comfort to buyers who are faced with ambiguous notification provisions.
