Macfarlanes secures important judgment for PGA European Tour in dispute with LIV golfers

A team from Macfarlanes represented PGA European Tour in securing the dismissal of appeals by 12 pro golfers against sanctions imposed on them for playing on the breakaway LIV Golf tour.

In a well-publicised decision, an appeals panel appointed by Sport Resolutions rejected the players’ claims that their £100,000 fines and two tournament suspensions from the DP World Tour were unenforceable as an unlawful restraint of trade, anti-competitive in breach of the Competition Act 1998, and procedurally unfair.

The decision is available here.

The Macfarlanes team acting for PGA European Tour included partners Matt McCahearty, Dan LavenderChris Charlton, senior advisor Tom Usher, senior counsel Chloë Edworthy, senior associates Fred Snowball and Jennifer Reeves, and associates Zoe Carter, Daniel Fisher, Olivia Pearson and Joe Gaffney, with support from other members of the litigation and competition teams. Counsel for PGA European Tour were Marie Demetriou KC and Daniel Piccinin KC from Brick Court Chambers, and Ravi Mehta and Emmeline Plews from Blackstone Chambers.
